Gordon Rees Scully Mansukhani Partner Amanda A. King and Associate Brittney A. Nochimson successfully secured early, voluntary dismissal with prejudice of all claims brought against their client, a healthcare facility, in a New Jersey state court action.
The plaintiff, a former patient of the facility, alleged violations of the New Jersey Nursing Home Responsibilities and Rights of Residents Act in connection with care that he received at the facility more than two years prior.
GRSM pursued aggressive, early motion practice on the grounds that the applicable statute of limitations barred the plaintiff’s claims. By raising a statute of limitations defense early in the case, GRSM brought the matter to an efficient resolution, as the plaintiff voluntarily dismissed all claims, with prejudice, without proceeding to discovery.
This outcome highlights the strength of GRSM’s Long-Term Care practice, which is dedicated to protecting long-term care providers from complex claims by utilizing a deep understanding of industry-specific statutes and regulatory frameworks. As a trusted partner to skilled nursing and assisted living facilities, GRSM provides strategic counsel and strong litigation defense, effectively navigating the dynamic and evolving healthcare landscape.
