Former Las Vegas and Reno Managing Partner, now Senior Partner, Robert E. Schumacher, and Senior Counsel Dan McCain obtained remarkable back-to-back settlements at mediation for the same GRSM client, a national trucking company.
Both lawsuits, filed in Clark County, Las Vegas, Nevada, involved catastrophic injuries to the plaintiffs and 100% liability on the part of the drivers of the tanker trucks owned and operated by the firm’s client. In the first case, the plaintiff incurred $2.7 million in past medical expenses for a multilevel cervical fusion, lumbar surgery involving metal implants, and a left rotator cuff and labral repair. A future cervical surgery was also anticipated. Following intense negotiations several days after mediation, the case settled for $5 million.
In the second case, the plaintiff incurred approximately $1 million in past medical expenses for extensive treatment, including a two-level anterior cervical discectomy and artificial disc replacement at C5-6 and C6-7, implantation of a permanent spinal cord stimulator, multiple transforaminal epidural steroid injections at both the cervical and lumbar levels, extensive chiropractic care, and physical therapy. Future medical care was expected to include potential spine surgery, with projected future medical expenses exceeding $2.17 million. After a full day of mediation and extensive negotiations between the parties, the case settled for $2 million.
