Gordon Rees Scully Mansukhani Partner Hiawatha Northington II and Senior Counsel Sheridan Carr successfully secured summary judgment and dismissal with prejudice on behalf of the firm’s client in an action involving a motor vehicle collision pending in the Circuit Court of Hinds County, Mississippi.
The case arose from a rear-end collision on Interstate 220 in Jackson, Mississippi involving a commercial vehicle operated in the course and scope of the driver’s employment. The plaintiff alleged that the defendants negligently operated the vehicle and sought damages resulting from the collision.
Following discovery and investigation of the incident, Northington and Carr moved for summary judgment relying on objective evidence, including the official crash report, dash camera footage, and video evidence recorded immediately after the collision. The evidence established that the plaintiff rear-ended the client’s vehicle after missing an exit while traveling above the posted speed limit. Video evidence further captured the plaintiff admitting fault and acknowledging that he had been distracted immediately before the accident.
The court granted the motion for summary judgment and dismissed the case with prejudice. In its ruling, the court found that the dash camera footage and post-accident video conclusively established the absence of liability on the part of the defendants.
