GRSM Partner Roy Viola Secures Dismissals in Three New Jersey Talc Cases on Behalf of National Manufacturer

Gordon Rees Scully Mansukhani Partner Roy Viola successfully obtained dismissals in three separate jurisdictional motions on behalf of GRSM’s client, a national manufacturer of personal hygiene products, in New Jersey.

In each case, the plaintiffs, none of whom resided in New Jersey, alleged harm from the use of the client’s products in their respective home states. GRSM argued that the client, a Missouri-based company that manufactures its products outside of New Jersey, had no direct connection to the state in these matters. The plaintiffs attempted to establish jurisdiction by pointing to the sale of the client’s products by major retailers within New Jersey. However, GRSM countered that such general sales activity did not establish the necessary link between the plaintiffs’ claims and the forum state. GRSM argued that, under recent Supreme Court rulings on jurisdiction, the cases should be dismissed because they lacked any meaningful connection to the state of New Jersey.

The court agreed with GRSM’s jurisdictional arguments in all three matters, rejecting the plaintiffs’ claims and granting dismissal. These rulings reinforce a series of favorable outcomes for GRSM’s client in New Jersey, underscoring the effectiveness of the firm’s early and assertive strategy in challenging “forum shopping” litigation.
