Gordon Rees Scully Mansukhani Partner William Mitchell, with support from second chairs, Of Counsel Lance Litman and Associate Chloe Flynn, as well as Paralegal Michelle Hernandez and Legal Assistant Julia Simpson, successfully obtained back-to-back voluntary dismissals in two first-party property lawsuits on behalf of the firm’s client, an insurance carrier.
Both lawsuits were brought by insureds seeking more than six figures for the cost of repairing damages to their residential properties. The insurance carrier denied coverage for both losses based on its investigation and applicable policy exclusions. Both matters were fully prepared to proceed to jury trials, which would have been proceeding one week after the other in two different counties in Florida.
In each case, and just before trial, the plaintiffs voluntarily dismissed their claims. Facing GRSM’s experienced trial attorneys who utilized early proposals for settlement, strategic motion practice, and extensive expert preparation, both sets of plaintiffs opted to abandon their claims rather than present them to a jury. Mitchell’s group obtained seventeen of these types of dismissals in 2025, with the majority of the dismissals resulting in recovery of the client’s incurred taxable costs in the cases where the client did not agree to accept a walk-away offer.
