Gordon Rees Scully Mansukhani Albuquerque Partners Spirit Gaines and Michael Rumac successfully defended a small pilot car company and its driver in a high-stakes case involving allegations of negligence and significant damages.
The plaintiff claimed that the pilot car driver failed to adequately warn of the oversize load being escorted, resulting in the plaintiff’s need to take evasive action that caused his 18-wheeler to tip over. The plaintiff sought more than $20 million in damages, alleging that the incident resulted in a traumatic brain injury.
Throughout a challenging two-week trial, the GRSM team vigorously contested the plaintiff’s allegations. The jury found 0% liability to the pilot company and sole owner, and while the jury found some liability on the part of the pilot car driver, they significantly reduced the plaintiff’s potential damages. Based on the jury’s assessment of fault, even if the plaintiff had been entitled to recover, the award would have been less than $125,000.
In a decisive legal move, Gaines successfully argued for the application of Texas law, despite the trial taking place in New Mexico. Consequently, the jury found the plaintiff to be more than 50% responsible for the incident, which ultimately barred any recovery, resulting in a complete defense verdict for the pilot car company and its driver.
