GRSM Secures Complete Dismissal for Client in Complex Debt-Related Dispute

Gordon Rees Scully Mansukhani Partner Melissa J. Brown and Associate Mercedes N. Robertson secured the complete dismissal of a law firm client from a complaint alleging violations of the Fair Debt Collection Practices Act (“FDCPA”), the Consumer Credit Protection Act (“CCPA”), and civil conspiracy, in a case where the plaintiffs sought seven-figure economic damages.

In the underlying matter, GRSM’s client represented an estate in a dispute seeking repayment of an unpaid debt owed by the plaintiffs. After the court ruled that the plaintiffs were liable to the estate for the debt, the plaintiffs filed a complaint against GRSM’s client and the estate, alleging violations of the FDCPA and CCPA and claiming civil conspiracy in connection with the debt collection efforts.

The GRSM team filed a motion to dismiss, asserting that the plaintiffs’ claims were barred by the entire controversy doctrine, res judicata, and collateral estoppel, as these issues had already been definitively addressed in the underlying litigation. Following extensive briefing and oral argument, the court ruled in favor of Brown and Robertson, dismissing all claims with prejudice and preventing any further legal action on the matter.
