Gordon Rees Scully Mansukhani Partner Tom Joensen, with support from Senior Counsel Holly Piper and Paralegals Jennifer Joensen and Peggy Rosky, secured a defense verdict on behalf of an emergency room physician in a medical malpractice trial.
The plaintiff’s estate, husband, and son brought suit against an emergency room physician and hospitalist, alleging a failure to diagnose and test the patient appropriately and arrange a timely transfer, ultimately leading to the patient’s death. The defendant physician denied liability and disputed that his actions caused the death.
At trial, the defense maintained that the physician’s care met the applicable standard of care. After hearing the evidence, the jury found that the defendant physician was not negligent, returning a defense verdict in his favor.
