GRSM Secures Early Summary Judgment on Behalf of Bar and Restaurant Group in Texas Dram Shop Case

GRSM Partner Delia Rivera won a complete summary judgment on behalf of a large bar and restaurant group in a dram shop case filed in Harris County, Texas.

This case involved a claim in which the plaintiff asserted that a guest at a bar located in Midtown Houston was overserved and subsequently struck the plaintiff’s vehicle in an auto accident on January 16, 2023, causing serious bodily injury. The plaintiff sued the improper party and failed to provide the court with sufficient evidence to overcome the bar’s arguments that it did not overserve the alleged intoxicated driver and that there was no violation of the Texas Alcoholic Beverage Code.

The motion for summary judgment was filed early in the litigation, prior to protracted litigation relating to the plaintiff’s alleged damage claims.
