Gordon Rees Scully Mansukhani attorneys Melissa J. Brown and Jonathan R. Stuckel successfully secured summary judgment in favor of their client, a healthcare employer, in an employment discrimination lawsuit filed under the New Jersey Law Against Discrimination (LAD).
The plaintiff, a former medication aide, alleged wrongful termination due to race, ethnicity, and national origin discrimination. Through thorough discovery, the GRSM team was able to show that the plaintiff’s termination was based on repeated violations of the employer’s policies and procedures, including a failure to administer insulin to a resident, which was documented through progressive discipline measures. The plaintiff was unable to provide evidence supporting his claims, relying primarily on assumptions and hearsay.
The court agreed with GRSM’s arguments that the termination was based on legitimate, non-discriminatory reasons and granted summary judgment, dismissing the claims against the firm’s client with prejudice.
