GRSM South Jersey Team Obtains Dismissal on Behalf of Psychiatric Healthcare Facility Client

Gordon Rees Scully Mansukhani Partner Amanda A. King and Associate Ashley A. Varghese obtained dismissal on all claims against the firm’s client, a psychiatric healthcare facility, in a New Jersey state court action.

The plaintiff, a former patient involuntarily committed to the facility, brought claims against the client under the New Jersey Law Against Discrimination, including disparate impact, public accommodations, retaliation, hostile environment discrimination, as well as medical malpractice, intentional infliction of emotional distress, breach of contract, and punitive damages. The plaintiff filed two amended complaints in this matter, which were substantially similar in form and substance.

In response, GRSM moved to dismiss the plaintiff’s second amended complaint for failure to state a claim upon which relief can be granted. After hearing oral arguments of counsel, the court dismissed the plaintiff’s claims for medical malpractice, intentional infliction of emotional distress, breach of contract, and punitive damages with prejudice. The plaintiff’s New Jersey Law Against Discrimination claims for disparate impact, retaliation, and hostile environment discrimination were dismissed with prejudice, while the public accommodations claim was dismissed without prejudice.
