GRSM South Jersey Team Secures Complete Defense Verdict for Condominium Association

Gordon Rees Scully Mansukhani South Jersey Partner Jonathan Stuckel and Associate Ashley A. Varghese secured a complete defense verdict at trial in a debt collection action in the New Jersey Superior Court, Special Civil Part, against the firm’s client, a condominium association.

The condominium association instituted a debt collection action against the unit owner. In turn, the unit owner filed a third-party complaint against the association and two individuals on the association’s board for breach of fiduciary duty and gross negligence. The unit owner alleged that paint splatter on the property, caused by the association’s contractor, constituted gross negligence and a breach of fiduciary duty, which allegedly necessitated nonpayment of fees.

GRSM argued that there was no fiduciary relationship between the association, its board members, and the unit owner, and that the paint splatter did not constitute gross negligence. GRSM further argued that the association and individual defendants were protected by the Business Judgment Rule, and that there was a lack of sufficient evidence to support the unit owner’s claims for gross negligence or breach of fiduciary duty.

The court entered a ruling in favor of the defense, dismissing the unit owner’s third-party complaint with prejudice for failure to sustain his burden of proof by a preponderance of the evidence.  This outcome reflects GRSM’s depth of experience in its Real Estate practice, consistently delivering successful outcomes in complex housing disputes.
