Gordon Rees Scully Mansukhani Of Counsel Bill Mitchell successfully obtained summary judgment on behalf of the firm’s home and commercial property insurance company client.
In the motion, Mitchell argued that the insurer had not breached the policy when it denied coverage for the insured’s water damage claim. The insurer determined that the loss resulted from an ongoing, long-term condition excluded under the terms of the policy.
Despite extensive deposition testimony, the court agreed that the insured failed to meet the burden of establishing a genuine issue of material fact regarding the causation of the claimed damages.
Following the expiration of a proposal for settlement, the insurer will also seek recovery of its attorneys’ fees and costs.
