GRSM Team Obtains Complete Dismissal of Negligence Claims Against Commercial Property Owner

Gordon Rees Scully Mansukhani Partner Michael V. Slivjak and and Associate John M. Russell successfully moved for summary judgment on all claims against their client, a commercial property owner in Atlantic City, New Jersey.

The plaintiff, who passed away during the pendency of the lawsuit, alleged a trip-and-fall on an uneven public sidewalk, suing multiple neighboring public and private entities. Slivjak and Russell aggressively pursued dismissal throughout the litigation, including an early motion on the statute of limitations and frivolous litigation notice. Through discovery, they obtained a copy of a pre-suit investigation report and, comparing its contents with public records, were able to demonstrate the alleged accident did not occur on their client’s property.

The court ultimately agreed, granting summary judgment without requiring oral argument.
