GRSM Team Obtains Summary Judgment in Subrogation Dispute on Behalf of Insurance Carrier Client

Gordon Rees Scully Mansukhani Fargo Partner Haylee Culver and Missoula Associate Natalie Hammond won a complete summary judgment on behalf of GRSM’s insurance carrier client who had been sued for subrogation.

The plaintiff brought the action against the carrier for subrogation relating to a fire at a community residential structure. The plaintiff argued that GRSM’s client’s consolidated insurance program should cover the subject loss instead of their property coverage and demanded more than $400,000 in damages.

GRSM successfully argued that the project owner had waived subrogation in the contract documents and that the subject loss was not covered by the consolidated insurance program policy. The court agreed, granting summary judgment in favor of the defendant.
