Victory for GRSM’s New York Commercial Litigation Team in High-Stakes Premises Liability Case

Gordon Rees Scully Mansukhani is proud to announce a significant win by its New York Commercial Litigation Team. Senior Counsel Thomas Fanizzi and Partners Joseph Salvo and Steve Zakrzewski successfully obtained summary judgment on behalf of their parking management client in a premises liability action pending in the Supreme Court, Kings County.

The plaintiff, who demanded $3 million in damages, alleged serious injuries after being struck by a descending automated gate arm at a Brooklyn parking facility. GRSM’s team demonstrated that the gate system was fully compliant with industry safety standards, that no defect existed, and that the plaintiff’s conduct—knowingly walking into a vehicle-only exit lane—was the sole proximate cause of the incident.

The court agreed, holding that the condition was open and obvious, not inherently dangerous, and that the plaintiff’s claims failed as a matter of law.
