Aggie Akers handles all areas of insurance coverage law including assisting clients with Special Investigation Unit (SIU) investigations, pre-litigation best practices, insurance policy interpretation, issues regarding independent counsel, bad faith litigation, actions for declaratory relief, disputes between multiple coinsurers and related appeals.
- Represented individual and entity clients in general liability and landlord-tenant civil litigation.
- Drafted persuasive motions, discovery, and other legal documents to further client defense positions.
- Prosecuted declaratory relief actions on behalf of carriers to resolve coverage issues under all types of liability policies and provided daily transactional advice to claims representatives.
- Represented carriers at mediations and settlement conferences and negotiated settlements which saved institutional insurance clients an estimated $5 million over 5 years.
- Orchestrated civil litigation defense of personal injury actions by preparing appropriate pleadings, drafting discovery requests and responses, analyzing records, and drafting appropriate motions, and handled on average 30 litigation cases at a time.
- Conducted and defended depositions of parties, witnesses, and experts.
- Wrongful death case with undisputed defendant liability. The 12-0 jury verdict was $2.1 million despite the suggestion of a $3.0 million verdict by the defense and plaintiffs asking for $68.5 million during closing arguments.
- Wrongful death case resulting from a pickup truck versus mini-bike accident. Obtained a 12-0 defense verdict, despite plaintiff retaining well-known plaintiff firm.
- Personal injury case with admitted defense liability. Obtained 12-0 defense verdict, which awarded both plaintiffs $0 in damages. Defendant was also awarded costs because plaintiffs rejected statutory offer to compromise.
