Alison Shilling has more than sixteen years of experience litigating complex commercial matters in state and federal courts in New York and California. Her specialty lies in identifying the broader case strategy and crafting creative, effective approaches to dispute resolution through strategic use of civil procedure and rigorous legal analysis. Alison has represented a broad range of clients, including insurers, reinsurers, property managers, property owners, individuals, and business entities, advising them from pre suit matters through appellate work. She approaches each matter with an eye toward mitigating risk and preventing future disputes.
- Integral litigation team member managing numerous litigations and arbitrations in multiple jurisdictions to close a syndicate’s book of business which had been predicted to handicap the viability of Lloyd’s of London.
- Successfully took a case of first impression to the New York Court of Appeals, advocating that the AAA International Commercial Rules require arbitrators, rather than courts, to decide arbitrability under the New York Arbitration Act, which later informed the Federal Arbitration Act.
- Successfully settled a $500,000 matter for $5,000 through persistence in pursuing repudiation and promissory estoppel theories on behalf of a guarantor on a defaulted $1,000,000 bank loan.
- Convinced Plaintiff to outright dismiss his lawsuit against her client with prejudice by identifying Plaintiff’s Federal Rule of Civil Procedure 11 exposure.
