Casey Shaw is an experienced litigator in GRSM’s San Diego office, and an active member of the Tribal & Native American, Appellate, Government, Insurance, and Environmental & Toxic Tort practice groups. His practice spans the gamut of civil defense cases, focusing in personal injury, commercial liability, governance, land use, ERISA, and appellate matters. Casey possesses a heavy law and motion background with proven success defending claims from pre-litigation through discovery and dispositive motions. He additionally has extensive government advisory experience working with various California Indian tribes and Southern California public agencies.

Tribal Law / Government / Administrative Law

Casey regularly defends California tribal governments and tribal officials in a broad range of civil litigation matters, from premises liability, to wrongful death, to tribal law enforcement, to governance and oversight. He zealously upholds his clients’ sovereign immunity, quashing or dismissing several lawsuits improperly filed in state and federal court through his ardent and proven motion practice. His governmental background lends itself to successful representation of tribal officials by asserting their various personal immunities in developing areas of the law. 

Before joining GRSM, Casey practiced for a decade representing various Southern California cities and public agencies in both litigation and advisory capacities, focusing in land use, CEQA, inverse condemnation, eminent domain, environmental, dangerous condition of public property, development, employment, and general liability matters.

Casey’s vast civil litigation and legal writing background lends itself to a broad appellate practice, welcoming all varieties of client appellate needs. He has briefed and argued several state and federal appeals, both in civil and criminal arenas, consistently guiding clients to success. Casey also has extensive experience handling writ of mandate and extraordinary relief actions to accommodate his clients’ unique and emergency needs.

Healthcare & ERISA

Casey regularly defends healthcare insurers in arbitration and litigation brought under both ERISA and state law. These cases involve a variety of issues including claims brought against health insurers by both their members and healthcare providers. He has successfully resolved several breach of contract, bad faith, and underpayment of benefits claims for a fraction of the damages initially alleged.
