Charles Byrom focuses his practice on creditors’ rights matters. Since 2002, Charles has developed experience at all levels of the collections industry, beginning as a telephone collector and later transitioning into the role of attorney. He represents banks, credit unions, consumer finance companies, assignees of financial institutions, commercial and residential landlords, and medical providers in efforts to recover property and accounts receivable at both the trial and appellate levels.
- Successfully represented the plaintiff at trial and on appeal in Wood, et al v. American Express National Bank, CL 2024-0030, Ala. Civ. App., Sept. 20, 2024, unreported, securing a judgment establishing joint and several liability of both the cardmember and the cardmember’s business based on credit card terms without the need for a separate personal guaranty
- Represented Midland Funding, LLC in Cook v. Midland Funding, LLC, 208 So.3d 1153, Ala. Civ. App. 2016, where on rehearing the court affirmed the admissibility of an assignee’s business records and reinforced that a plaintiff is the master of its complaint, preventing recasting of claims to apply shorter statutes of limitation
- Successfully represented the appellant in Alabama Telco Credit Union v. Gibbons, 195 So.3d 1012, Ala. Civ. App. 2015, obtaining a ruling that claims of exemption must include a sworn inventory sufficiently identifying personal property and cannot rely on vague descriptions
