Drawing on more than decades of litigation experience, Dana L. Burch represents employers in complex employment disputes and provides strategic advice and counsel to help organizations navigate challenging workplace issues, manage legal risk, and prevent costly litigation.

Dana represents private businesses, public entities, educational institutions, and nonprofit organizations in matters involving discrimination, harassment, retaliation, wrongful termination, whistleblower claims, disability accommodations, leaves of absence, and wage and hour disputes. Her practice includes litigation in state and federal courts, arbitration proceedings, administrative agency matters, and alternative dispute resolution.

An experienced attorney, Dana has handled all phases of litigation, including discovery, depositions, dispositive motions, settlement negotiations, trials, and appeals.

In addition to litigation, Dana regularly advises employers and human resources professionals on personnel decisions, workplace policies, performance management, employee discipline and termination, reasonable accommodations, leaves of absence, and employment law compliance. Drawing on her litigation experience, she helps clients recognize potential legal exposure and develop proactive strategies to minimize risk. She understands that employers need more than an explanation of the law; they need practical, timely guidance that considers their operational realities and organizational objectives.

Dana is a frequent speaker and workplace trainer who enjoys helping employers and managers better understand their legal obligations. She presents on a variety of employment law topics, including disability accommodations, protected leaves, harassment prevention, effective management practices, and emerging workplace legal issues. Her presentations emphasize practical solutions, real-world scenarios, and strategies employers can implement to reduce workplace disputes.

Dana also writes on developments in employment law. Her article, Whistleblower Retaliation in California: Heightened Burdens and the Emergence of a 90-Day Presumption, was published in the Fall 2025 issue of Defense Comment. She is particularly interested in helping employers understand how evolving legal standards affect everyday personnel decisions and litigation risk.

Before concentrating her practice on employment law, Dana handled complex toxic tort, product liability, and premises liability litigation. She served as national coordinating counsel for a client facing more than 500 active cases across multiple jurisdictions. This experience strengthened her skills in litigation management, strategic planning, risk assessment, and the defense of high-exposure claims.

Dana is committed to developing strong client relationships built on communication, responsiveness, and trust. Whether defending a lawsuit, advising on a sensitive workplace decision, or presenting to management teams, she strives to provide straightforward, practical guidance that helps clients make informed decisions and achieve their goals.
