With over 20 years of legal experience, David Graziani handles a broad range of complex litigation, general liability defense, and commercial and construction litigation matters. He has successfully settled and resolved hundreds of cases, including several bench trials in New York and California.
David has represented regional, national, and international corporations and individuals in high-stakes matters across various industries, including insurance, construction, real estate, entertainment, media, fashion, civil rights, and general commercial law. He has extensive experience defending clients in complex product liability and tort cases, including catastrophic personal injury, wrongful death, and property damage claims.
- As the first-chair trial attorney, David successfully secured a defense judgment on all 21 causes of action for a prominent supermarket chain in a complex eight-day business litigation bench trial held in Los Angeles County Superior Court in August 2024. The Cross-Complainants sought $75 million in damages, alleging claims of conversion, intentional interference with contractual relations, and negligent/intentional interference with prospective business advantages. David drafted and filed the trial brief, exhibit and witness lists, motions in limine, and delivered the opening statement. He also made an oral motion for dismissal pursuant to C.C.P. 631.8, presented evidentiary objections during the trial, and conducted direct and cross-examinations of key witnesses.
 - In October 2025, the Court granted the City of Fontana’s demurrer to the First Amended Complaint, agreeing to dismiss the dangerous condition claims brought by the two estate plaintiffs without leave to amend and striking the punitive damages claims, as well as several paragraphs in the FAC. Additionally, the Court sustained the demurrer for failing to comply with pre-filing Government Claims Act requirements, and found that the FAC failed to allege sufficient facts to support a cause of action for a dangerous condition under Government Code § 835, where plaintiffs’ counsel was seeking $9.5 million per estate plaintiff.
 - Successfully represented celebrity fashion designer Brian Lichtenberg and his company in a case involving trademark, trade dress, and copyright infringement, as well as Lanham Act claims, trade secret violations, and business interference. David secured a Temporary Restraining Order in California Superior Court and a Preliminary Injunction issued by Hon. Dean Pregerson of the U.S. District Court for the Central District of California. The judge found a likelihood of success on the merits of the trade dress, trademark, copyright, trade secret, and business interference claims, thereby protecting their intellectual property rights and reputation in the fashion industry.
 - Led a medical billing fraud investigation into a physician’s fraudulent business and billing practices, uncovering approximately $300,000 in fraudulent insurance claims. David conducted numerous Examinations Under Oath (EUOs) as part of fraud investigations involving clinic owners, treating physicians, medical providers, and allegedly injured claimants, all related to fraudulent billing and business practices.
