Earlier in his career, Evan represented homeowners’ associations in complex construction defect matters and later established his own practice focused on representing owners, contractors, subcontractors, and material suppliers in construction defect disputes, with an emphasis on luxury custom homes. His experience includes matters involving soil erosion, grading, paving, flatwork, swimming pools, foundations, landscaping and irrigation, framing, exterior surfaces, windows, HVAC systems, electrical, plumbing, waterproofing, and roofing. He works closely with forensic consultants to identify defects and develop effective repair strategies while maintaining a professional and collaborative approach to dispute resolution.
Real Estate Transactions
Evan has litigated numerous real estate sales disputes involving concealment, misrepresentation, partition, foreclosure, quiet title, and commercial lease issues through arbitrations and trials. He has also overseen transactions following construction defect litigation and advised regarding disclosure obligations to help prevent future disputes involving subsequent property owners.
Product Liability
Evan has represented individuals and families who sustained catastrophic injuries or wrongful death resulting from safety equipment failures. His experience includes working with experts in biomechanics, engineering, and consumer product safety standards to analyze product design, testing, manufacturing, and distribution issues.
Casualty
Evan has litigated hundreds of casualty and wrongful death matters arising from machinery, heavy equipment, construction incidents, trucks, automobiles, motorcycles, ATVs, and premises liability claims. He collaborates with accident reconstruction specialists, medical experts, economists, vocational rehabilitation consultants, and life-care planners to develop effective case strategies and presentations.
Bankruptcy, Restructuring & Creditors’ Rights
Evan has drafted, recorded, and foreclosed more than 300 mechanic’s liens on behalf of general contractors, subcontractors, and suppliers. He has also successfully presented claims involving payment bonds, performance bonds, and contractor’s bonds. In addition, he has assisted creditors with judgment collection efforts through negotiation and investigative techniques.
