Gabriel C. Toth, Jr. advises clients on complex litigation and regulatory matters, with a focus on corporate litigation, medical malpractice defense and the cannabis industry’s licensing, compliance, and operational frameworks. He manages a high-volume docket of complex civil matters, from discovery and depositions through motion practice and pretrial proceedings, and partners with carriers and experts to drive efficient, defensible outcomes. Gabriel also brings first-hand industry experience from senior roles in cannabis cultivation and manufacturing, where he led regulatory planning, SOP development, and state licensing submissions for New Jersey facilities.
- Managed a caseload of more than 30 medical malpractice actions across seven carriers, ensuring carrier-specific reporting, deadlines, and strategic prioritization.
- Conducted 60+ and defended 20+ depositions; argued and won 25+ motions, including dismissals for invalid affidavits of merit, summary judgment after expert challenges, motions to bar direct damages, venue transfers, and a pro bono FRO dismissal.
- Co-founded and developed a cannabis practice group focused on licensing, regulatory compliance, and litigation; presented at conferences and before the NJCRC.
- Directed regulatory and legal planning for Class I cultivation and Class II manufacturing facilities targeting first-to-market positioning in New Jersey’s adult-use program; prepared all state licensing and regulatory submissions and compliance frameworks.
- Oversaw 12+ hemp cultivation cycles and large-scale operations (indoor and 8-acre outdoor), supervising teams and ensuring compliance with state agriculture regulations, testing, and reporting.
