Joshua I. Rodriguez focuses his practice on construction litigation, construction transactions, commercial litigation, and related business matters. He represents clients in matters involving construction projects, contract disputes, payment claims, construction and commercial agreements, compliance issues, and other business-related controversies.
- Prepared New York City agency determinations for responding to construction disputes under Article 27 of the New York City Standard Construction Contract, including the rejection of a $1.5 million claim for excavation work at a Fresh Kills compost facility; a $400,000 claim for parapet-railing installation at a Brooklyn garage based on alleged design defects and Building Code violations; and a $225,000 claim for sidewalk elevation remediation related to a Builder’s Pavement Plan, where the contractor failed to identify and timely cure the underlying defects. Coordinated with the New York City Law Department to defend agency determinations in contractor appeals before the New York City Comptroller and Contractor Dispute Resolution Board, including developing legal strategy, arguments, and the factual record.
- Negotiated and structured complex infrastructure and vertical construction transactions, including a heavily negotiated construction and operation agreement authorizing a utility to construct transmission facilities and feeders at a closed New York City landfill, a $150M+ brownfield redevelopment/garage construction lease that secured $5M-plus in landlord reimbursement obligations for soil and wetlands remediation and required advocacy before New York City Bureau of Standards and Appeals for a waiver for a GCL § 36 land use waiver due to the garage’s lack of frontage on a mapped city street, and a sublease with FAA on a City leasehold for a Wind Shear System for LaGuardia Airport. Drafted and negotiated access agreements and license agreements involving adjacent or neighboring properties.
- Negotiated and structured licenses and interagency agreements supporting landfill, environmental, and public infrastructure projects, including DEP improvements, shoreline restoration, emergency preparedness facilities, and combined sewer overflow infrastructure. Advanced, prepared, and revised a variety of design, construction, and consulting procurements, including a major architecture and engineering RFP, various construction procurements, and landfill and environmental services contract.
- Managed legal review of the programmatic Environmental Assessment Statement for DSNY’s ten-year Solid Waste Management Plan, the EAS required to advance delivery of a multi-district garage project delivery, and three interrelated CERCLA actions. Handled complex interagency matters involving FAA, NPS, NYPD, Amtrak, the Gateway Development Commission, MTA, and EDC.
