General civil litigation attorney Lance M. Litman has significant experience across many insurance defense areas. Lance focuses his practice on construction defect, real estate, design, and general liability. Additionally, he has a proven track record in delivering results for his clients in commercial and residential first party property disputes, contract disputes, and negligence matters including rideshare policies. Through many years of experience, Lance is adamant that regular ongoing communication with his clients in conjunction with an agreed case specific strategy and plan of action are the keys to successful resolutions. Lance prides himself on being detail oriented and embraces an outside of the box perspective in working with clients to create the most efficient, cost-effective litigation plan to reach the result sought by his client in each case.

Lance is very hands on and involved in every phase of a case or dispute from inception through final resolution. He has routinely delivered positive results in resolving pre-suit matters by working to understand the motivations of all parties involved and pursuing various avenues to reach early resolution where possible. Lance also believes every case must driven from mindset that it will be going to trial. Mindful to avoid unnecessary costs, the fact remains that he will pursue and position each case in a proactive approach to ensure his clients are in the best position possible to leverage a favorable outcome.

In taking this approach to his cases, many end up resolved through mediation or arbitration. Lance has experience and success arguing summary judgment motions and other dispositive motions. Having completed hundreds of depositions of both fact witnesses and of expert witnesses, Lance recognizes the importance of preparation for such events.

Lance regularly attends site inspections with experts from both sides to ensure he understands the nuances of each property, and any testing conducted by experts to allow him to better ask the relevant questions, make appropriate recommendations, and ultimately provide his clients with better results.

In his practice, Lance has represented most of the largest private insurance carriers over the years, as well as entities such as the Florida Insurance Guaranty Association (“FIGA”). Lance also represents contractors, engineers, project managers, developers, real estate investors and other industry related entities and professionals.

Prior to joining GRSM, Lance was a partner at another well known national law firm where he represented insurance companies primarily in first party property cases.

Lance has experience, and a continued interest in the real estate industry, including real estate investment deals ranging from single property purchases and sales to acquisitions of institutional level portfolios.

Lance maintains a Florida Real Estate license.

  • Secured summary judgment in favor of the insurance carrier on the issue of what qualifies as property damage and subsurface material in a cast iron pipe case.
  • Secured summary judgment in favor of the insurance carrier where a plaintiff, through a valid assignment of benefits agreement, contracted to complete a roof repair but had no standing to pursue the lawsuit as the assignor had subsequently sold the real property, no actual work had been conducted, and the insurance carrier had no opportunity to investigate the claim prior to the conveyance of title.
  • Secured summary judgment in favor of the insurance carrier where plaintiffs’ expert engineer testified that it relied entirely upon having found wind damage to more than twenty-five percent of the roofing system. Lance argued that considering the revised building code and correlating statute, where a structure is built in compliance with the 2009 (or newer) building code, the twenty-five percent rule was inapplicable and could not be the sole basis to mandate a full roof replacement.
