Michael R. Ayers’ practice focuses on complex commercial litigation and liability defense with an emphasis in the areas of insurance coverage, construction defect, Carmack Amendment and large property loss subrogation, product liability claims, contract disputes and personal injury matters. He has represented major fast food chains, fire protection system designers and manufacturers, and some of the largest insurance companies in more than 24 states.

Michael is a trial lawyer involved in all phases of litigation, including pre-trial work, conducting depositions, discovery and dispositive motions, and attending hearings, mediations, arbitration and settlement negotiations. He has successfully defended clients in government investigations, subpoena responses, and other proceedings involving state agencies. His clients have included some of the largest financial institutions and collection companies in the nation and smaller enterprises and Internet-based providers. He represents banks, financial institutions, and collection agencies in federal and state courts across the United States.

Michael spent nearly 10 years in Phoenix, Arizona handling complex commercial litigation, consumer financial services laws, including the Fair Debt Collection Practices Act (FDCPA), Telephone Consumer Protection Act (TCPA), and the Fair Credit Reporting Act (FCRA ) defense; medical marijuana, employment and construction defect cases throughout Arizona, including in the Gila River Tribal Court, Nevada and in the Federal District Court of Colorado and Utah. He has handled and defended class action lawsuits in the Federal District Courts of Arizona and Nevada; and served as outside general counsel for companies in the representation of contract negotiations, litigation disputes, labor and employment issues, risk management, and defending class actions lawsuits in Federal courts.

  • Served as outside general counsel assisting with all issues involving the companies including contract negotiations, litigation disputes, labor and employment issues and risk management.
  • Handled and defended class action lawsuits in the Federal District Courts of Arizona, Colorado, and Nevada.
  • Construction defect defense of contractors, subcontractors, and engineers in Arizona, Colorado, and Nevada.
  • Managed and litigated approximately twenty to thirty complex commercial litigation, class actions, consumer finance (FDCPA, TCPA, and FCRA defense), medical marijuana, employment and construction defect cases throughout Arizona, including in the Gila River Tribal Court, Nevada, and in the Federal District Court of Colorado and Utah.
  • Co-chaired bench and jury trials.
