- Secured dismissal with prejudice of a nine-count wrongful death and related claims action against a private school in New York Supreme Court, obtaining pre-answer dismissal under CPLR 3211 by establishing no legal duty to prevent off-campus self-harm, lack of proximate cause, and failure to state viable claims, including negligence, emotional distress, breach of contract, and fiduciary duty, with the court finding the allegations speculative and legally insufficient.
- Obtained summary judgment dismissing all claims, cross-claims, and third-party claims against a site safety consultant in a multi-party New York Labor Law action, establishing the client acted in a strictly advisory capacity with no authority to supervise work or enforce safety, and was not a statutory agent under Labor Law §§ 200, 240(1), or 241(6), with the court holding the governing contract controlled and foreclosed liability.
- Achieved a unanimous defense verdict following a six-day jury trial in New York Supreme Court, defeating claims for breach of contract, unjust enrichment, quantum meruit, and violations of New York labor law, by demonstrating no enforceable bonus agreement existed and successfully challenging plaintiff’s credibility, resulting in voluntary dismissal of quasi-contract claims and a complete defense verdict.
