- James W. Morgan v. Interstate Resources, Inc. – secured a motion for summary judgment for an international publically traded corporation against its former North American CEO’s claims for age discrimination, national origin discrimination, intentional/negligent misrepresentation and fraudulent inducement in the United States District Court, Southern District of Ohio.
- White Cap, L.P. v. Washoutpan.com, LLC, et al. – Obtained a $2,441,336.46 judgment for Plaintiff against an LLC and its owner for claims of false advertising, unfair competition, defamation, slander, tortious interference with business relations, Uniform Deceptive Trade Practices Act and RICO in the United States District Court, Northern District of Georgia.
- Environmental Research Center v. Technical Laboratories, Inc. – After successfully removing the case to United States District Court, secured a Motion to Dismiss for lack of personal jurisdiction for a laboratory in Tennessee against a professional negligence and breach of contract action originally filed in Superior Court.
- Park Place Commercial, LP v. Double Check, Inc., et al. – Secured a demurrer and motion to strike without leave to amend for an environmental services company against a plaintiff who alleged property damage as a result of underground storage tanks.
- Orange Redevelopment Agency v. City of Orange – Secured a motion for judgment on the pleadings for a municipal entity striking plaintiff’s causes of action under the Carpenter-Presley-Tanner Hazardous Substance Account Act as a result of a lack of compliance with Health & Safety Code section 25351.2 and striking plaintiff’s causes of action under the Porter Cologne Act for indemnity, contribution and declaratory relief as a result of a lack of any order of liability being issued by a regional or state board for contamination under Water Code section 13350, a necessary prerequisite for relief under the Act.
- Aria Greenlee v. BASF Catalysts LLC – Secured motion for summary adjudication for a talc supplier in an asbestos related action which adjudicated plaintiffs’ causes of action for false representation, intentional tort/intentional failure to warn, and the prayer for punitive damages.
- James Lester David, et al. v. Aladdin Heating Corporation, et al. – Secured a motion for summary adjudication for a wholesale plumbing supplier in an asbestos related action which adjudicated plaintiffs’ causes of action for intentional tort, misrepresentation and plaintiffs’ claims for punitive damages.
