Wayne Gladstone is a seasoned litigator with a broad range of experience, from pre-suit risk analysis to trials and appeals. His litigation experience spans defending single-plaintiff cases to class actions, as well as serving as national counsel and local counsel in numerous multi-district litigations for life sciences clients. Wayne has personally overseen hundreds of litigations to completion, either directly or via oversight of local counsel, and negotiated countless settlements.

His litigation practice includes a wide array of high-profile product liability actions involving pharmaceuticals, medical devices, personal care products, hair dyes, and consumer-use products, including products named in class action PFAS litigations. He is also experienced in all phases of e-discovery, having supervised the attorney-client privilege review of one of the largest document productions in litigation history.

Wayne’s environmental practice focuses on both civil and criminal matters, including CERCLA matters, addressing claims of property damages, stigmatization, and personal injury alleged in response to exposure to mold, mixed chemical exposures, PFAS, residential heating oil, and other environmental factors. He has negotiated extensively with the Department of Environmental Conservation, representing a major oil distributor in three states at both the state and federal levels.

Wayne has also managed the selection and preparation of expert witnesses in diverse fields, including FDA regulations, proper maintenance of HVAC systems, and medical causation flowing from exposure to mold, oil, and other industrial hygiene products.

  • Defended energy clients in civil and criminal matters involving NYDEC/PADEP/NJDEP compliance as well as claims regarding property stigmatization, and medical injury stemming from oil exposure.
  • Defended manufacturers and distributors of pharmaceutical, medical devices and food products, serving as national and local counsel in multiple jurisdictions involving claims of illness from multiple causes including product defect, mold, and chemical (PFAS) exposure.
  • Represented New York’s largest corporate municipality, taking depositions as well as drafting and arguing dispositive motions in commercial and constitutional law matters.
  • Resolved numerous environmental actions involving claims of property damage and medical injury.
  • Completed a wide array of high-profile product liability work on a team recognized by the American Lawyer as a finalist for the 2008 Litigation Department of the Year.
  • Drafted numerous substantive motions and work products with an emphasis on FDA regulation, off-label promotion, and proximate causation.
  • Headed a 50+ privilege review team in one of the largest document productions in litigation history.
  • Drafted and argued dispositive product liability motions.
  • Numerous depositions included the successful impeachment of plaintiff’s damages expert regarding plaintiff’s alleged traumatic brain injury, obtaining a favorable settlement six weeks later.
  • Represented physicians, medical institutions, and pharmaceutical companies in medical malpractice and product liability cases.
