W. Austin Smith has  extensive experience in complex commercial and civil litigation. As a business litigator, Austin’s practice has focused primarily on business disputes including breach of contract actions, non-payment and debt collection actions, construction matters, data breach class actions, mineral rights disputes, interference with contracts or business relationships, and non-competition agreements.

Austin’s litigation background also includes defending businesses in personal injury, general liability, as well as professional liability matters. His experience allows him to be proactive to best position his clients to effectively negotiate and resolve disputes.

Austin’s practice at GRSM is focused on representation of construction clients litigating contractual and other disputes, catastrophic injury claim arising from construction accidents, and general business litigation.

  • Successfully represented prime contractor in pursuing claims of defective work performed in multiuse building.
  • Successfully represented a large, multinational chemical company in a petition for emergency injunction.
  • Successfully resolved dispute on behalf of a local dock repair business against vendor for claims of breach of contract and unfair practices.
