Cullen Guilmartin is a partner in the Hartford and Providence offices of Gordon & Rees and handles a wide range of litigation matters, including defending claims against manufacturers of complex commercial machinery, medical devices, consumer products and pharmaceuticals. He has handled complex personal injury and property suits involving alleged catastrophic injuries, including wrongful death and survivorship claims, and environmental contamination. Mr. Guilmartin has handled all phases of litigation in cases pending throughout the country and has been effective at attacking claims through successful Daubert motion practice to first-chairing trial to defense verdict on behalf of his clients.
Mr. Guilmartin also advises and represents clients on a variety of product liability law issues with a particular emphasis in the areas of product recalls, government reporting and product safety. Mr. Guilmartin has overseen nationwide product recalls, including primary handling of all governmental reporting.
Although, Mr. Guilmartin primarily practices in the areas of product liability law, toxic tort and mass-tort litigation, Mr. Guilmartin has experience litigating complex business litigation matters, including premises liability matters, subrogation, consumer fraud actions, construction injury and defect matters, professional liability and class action lawsuits. He has represented clients whose legal service needs straddle both ends of the spectrum – from various Fortune 500 companies to family-owned local businesses.
In addition, Mr. Guilmartin regularly represents employers in disputes in Connecticut and Rhode Island state and federal court, and before federal and state administrative agencies. He has defended a significant number of employers accused of wrongdoing including claims of discrimination, harassment, sexual misconduct, hostile work environment, infliction of emotional distress, and retaliation.
Mr. Guilmartin has also taken an active role as coordinating liaison counsel for over 100 law firms and 150 defendants in toxic tort litigation in Connecticut. In this capacity, Mr. Guilmartin coordinates with the Court and all plaintiffs' counsel regarding docket management, discovery, medical workup, motion practice and trial preparation.
Mr. Guilmartin has honed and enhanced his litigation skills by devoting significant time to the representation of pro bono clients, including the pursuit of claims alleging Civil Rights violations and claims involving domestic violence. In this regard, Mr. Guilmartin has received a pre-judgment remedy award of $1,000,000.00 on behalf of his client in a domestic violence personal injury action and has obtained numerous favorable settlements for victims of discrimination. He is also an accredited Veterans Administration attorney, regularly assisting veterans seeking to obtain disability and/or service connected injury benefits. He also has experience with discharge upgrades.
