Dan O’Shea maintains a diverse litigation practice defending and prosecuting actions involving franchise liability, commercial and business disputes, class actions, employment and product liability. His approach is to learn as much as possible about his clients and their businesses when preparing cases for trial, focusing on the details in order to achieve the best possible result for them. He is known by his clients for being responsive, always reachable, dependable, and worthy of their trust and respect. He represents his clients in both state and federal courts as well as in arbitrations and mediations throughout Northern California. He is a member of the firm’s Commercial Litigation, Product & General Liability, and Employment practice groups and is based in the firm’s Sacramento and San Francisco offices.
Mr. O’Shea represents franchisors and franchisees in cases which typically involve alleged negligence by employees of franchisees and injury or death on a franchise property. He routinely defends multi-million dollar cases involving catastrophic injuries and multiple deaths. His franchise liability practice includes representation of household name corporations in some of the most high profile cases in the country.
In his Commercial Litigation practice, Mr. O’Shea handles complex commercial disputes at both the state and federal level. Generally, his practice includes defending and prosecuting litigation involving contractual disputes; claims under California’s Unfair Competition Law; director and officer liability, securities cases, intellectual property, antitrust, and defense of financial services companies and insurance companies.
Class Action Defense and Consumer Protection Statutes
Mr. O’Shea defends companies involved in nationwide and state class claims based on alleged systematic violations of federal and state employment laws and cases arising under consumer protection statutes, false advertising, and unfair competition statutes, including, for example, the FDCPA (Fair Debt Collection Practices Act), and FCRA (Fair Credit Reporting Act).
Over the course of his career Mr. O’Shea has represented numerous manufacturers, suppliers, and premises owners in cases involving personal injuries caused by defective products, design defects, and failure to warn. These representations include, for example, representation of suppliers of products containing toxic substances such as asbestos, silica, and benzene, and manufacturers of everything from diving boards to nuclear submarines. He has prevailed numerous times on summary judgment in product liability cases.
