Biography

Eric T. Evans is an experienced trial lawyer and Partner in the New Jersey office.  Having taken 30 trials to verdict, Eric routinely handles class action and individual matters involving trucking accidents, health care, consumer protection claims, breach of contract, franchise issues, shareholder disputes, financial institution liability, professional negligence, sports and fitness club claims, construction claims and premises liability before federal, state and appellate courts.

Class Action Defense Including Consumer Protection Statutes
Eric routinely defends class action litigations including, federal and state class claims arising under consumer protection statutes and false advertising or unfair competition statutes, including alleged violations of the Fair Debt Collection Practices Act, Article 9 of the Uniform Commercial Code, and Federal Reserve Regulation E.

Health Care
Eric has defended health care providers involving physical trainers, assisted living facilities, emergency medical technicians, and licensed nurses involving claims of personal injury.

Product Liability
Eric defends clients in product liability matters. He has represented manufacturers of food products, batteries, pharmaceuticals, medical devices, consumer products, and in product liability matters.

Construction
Eric's construction experience includes defending general contractors, subcontractors, owners, developers, and design professionals regarding a diverse spectrum of matters involving both public and private works. Matters include alleged construction defects, breach of contract claims, alleged errors in design and workmanship, and construction site accidents.

Sports & Fitness
Eric devotes a significant portion of his practice to the representation of personal trainers and national fitness clubs, including providing guidance to clients on their membership agreements for compliance with the health club laws and the enforceability of exculpatory clauses. 

Banking/Financial Institution
Eric has extensive experience representing financial institutions, including multinational and regional banks and credit unions. His practice includes the handling of matters related to lender liability, including the defense of FDCPA, Article 9 of the Uniform Commercial Code, Federal Reserve Regulation E, commercial collections, and other matters related to lender’s rights.
