Erin P. McDaniel is Senior Counsel in the Nashville office of Gordon & Rees and is a member of the Health Care, Professional Liability and Employment practice groups. Prior to joining Gordon & Rees, Ms. McDaniel was an Administrative Judge for Tennessee Department of Human Services, Division of Appeals and Hearings, where she presided over administrative hearings concerning various human services.

Complex Litigation

Ms. McDaniel began her legal career in San Diego, California working on federal complex class-action litigation matters. Having grown up in the Nashville-area, Ms. McDaniel returned to her home town more than a decade ago. Here she has drawn on her complex litigation background while handling a variety of claims, including general negligence/tort, personal injury, wrongful death, professional liability, premises liability, various employment law matters and family law matters, as well as disputes between insurers and their insureds.  Ms. McDaniel has experience defending malpractice claims against professionals in a wide range of industries, including insurance agents and brokers, various healthcare providers, attorneys and directors/officers.

Health Care Law

Ms. McDaniel is the former Medicare Appeals Attorney Team Leader at a large national healthcare corporation, where she successfully recovered millions of dollars in medical necessity and level of care payment denials and take-backs for numerous health care providers including hospitals, inpatient rehabilitation facilities and skilled nursing facilities. Ms. McDaniel currently represents hospitals, physicians, assisted living and nursing home facilities, and other health care providers against a variety of claims, including malpractice and negligence, violations of the state-specific consumer protection acts, and various common law actions.

Employment Law

Ms. McDaniel regularly counsels and defends clients in matters concerning independent contractors, wage and hour laws, family and medical leave, unfair labor practices, Title VII, ADA and other employee-employer relations.

Community Involvement

Ms. McDaniel is an active volunteer, advocate and foster home for Middle Tennessee Boxer Rescue and Nashville Humane Association, and she regularly volunteers her time to the YMCA of Middle Tennessee. Ms. McDaniel is a former member of the Educational Assistance Committee for the Alpha Chi Omega Foundation.
