Garrett M. Fahy is Senior Counsel in the Irvine office of Gordon & Rees and is a member of the Commercial Litigation practice group. Mr. Fahy’s litigation practice concentrates primarily on complex business disputes involving intellectual property rights, corporate governance and control, breach of contract, fraud, breach of fiduciary duty, misappropriation of trade secrets, and unfair competition. He also has significant experience with products liability, professional liability, complex torts, business and probate, and premises liability. He’s represented national and international clients in state and federal actions through all phases of court proceedings and discovery, including the defense of class actions and multi-district litigation (MDL).

Mr. Fahy’s appellate practice has included drafting appellate briefs, writ petitions, petitions for review, and petitions for rehearing in matters before the California Supreme Court and the California Courts of Appeal, concerning business and election disputes. He has also prepared briefs filed in a matter before the United States Court of Appeals for the Fourth Circuit concerning physician due process rights in review hearings.

In the transactional realm, Mr. Fahy has helped clients in various fields (retail, software development, automotive industry, video production, housing) with entity formation, drafting/revising policies and procedures, commercial contract negotiations, responding to demand letters from competitors, and advising on new product offerings, intellectual property issues and legal compliance. He’s also practiced in trust and estate planning, and probate administration.

Finally, in the election law realm, Mr. Fahy regularly represents state and federal candidates, campaigns and initiative proponents in election contests across California before elections officials, trial and appellate courts, and the California Supreme Court. In connection with this experience, Mr. Fahy was appointed in 2018 as a Delegate to the California Republican Party, and in 2019, was appointed by Neal Kelley, the Orange County Registrar of Voters (ROV), to the OC ROV’s Community Election Working Group, which advises the ROV on election procedures amidst an ever-changing election law landscape.

Before joining Gordon & Rees, Mr. Fahy practiced in the Los Angeles office of Sedgwick LLP and at a litigation boutique in Irvine, Enterprise Counsel Group.

During law school, Mr. Fahy served as a research assistant to Pepperdine University School of Law Dean Kenneth W. Starr, competed in intramural moot courts as a member of the school’s Appellate Advocacy Team, including the Vis International Commercial Arbitration competition in Vienna, Austria, and also served as a Note & Comment Editor for the Pepperdine Journal of Business, Entrepreneurship and the Law, for which he wrote a published article on the Supreme Court’s opinion in the Title VII case of Ledbetter v. Goodyear Tire & Rubber Co., 550 U.S. 618 (2007).

Before law school, Mr. Fahy worked in a U.S. Senate leadership office, the Senate Republican Conference, where he supported the Senate confirmations of Supreme Court Chief Justice John G. Roberts and Associate Justice Samuel A. Alito, Jr., directed media strategy for the Senate leadership, drafted editorial articles for placement in national publications, and worked on various political campaigns.

Outside of work, Mr. Fahy is active in his church, enjoys vacations with his wife, writes and speaks on political issues, and volunteers on political campaigns in a legal capacity.

Mr. Fahy has been selected as a Super Lawyers Southern California “Rising Star” from 2015-2020.
