Mr. Blyskal advises private business clients and closely-held companies, individuals, and institutional clients in pre-litigation disputes and represents clients through trial and appeal in many different state and federal courts.

Mr. Blyskal regularly advises insurance companies throughout New England and in other states on first-party commercial property claims handling and litigation, including arson claims, and on third-party coverage issues and litigation arising under a variety of policy forms, including directors and officers, employment liability, commercial general liability, and excess and umbrella.

His insurance coverage practice includes both advising insurance companies on managing risk during the claims process and defending breach of contract and declaratory judgment actions. He also defends insurance companies from extra-contractual claims asserting unfair insurance practices, bad faith, and breach of implied covenants. Mr. Blyskal has bad faith trial experience.

In addition to his focus on insurance coverage, Mr. Blyskal advises clients confronting a variety of commercial and business disputes relating to contract formation and performance, unfair trade practices, ownership interests in closely-held companies, and intellectual property rights, including claims under the Lanham Act and the Copyright Act. He has particular experience negotiating non-competition and separation agreements and litigating restrictive covenants for companies and executives. In addition to these areas of emphasis, Mr. Blyskal also handles construction-related disputes involving contractual, defect, and design claims.
