Shelby A. Poteet is an Associate in the San Diego office of Gordon & Rees and is a member of the Commercial Litigation, Bankruptcy, Restructuring and Creditors’ Rights, D&O and Shareholder Litigation, Banking and Finance, and Consumer Protection Defense practice groups. Ms. Poteet represents clients throughout California in both state and federal courts. Ms. Poteet’s practice primarily consists of defending institutions in consumer protection statute claims, including FDCPA/Rosenthal, CLRA, UCL, and others. Ms. Poteet’s practice also includes contractual disputes, commercial collection, director and officer liability, and bankruptcy matters.
Prior to joining Gordon & Rees, Ms. Poteet represented insurers in subrogation cases involving negligence, products liability, inverse condemnation, and government claims. Ms. Poteet has second chaired two successful bench trials, one involving a subrogation case stemming from automobile negligence and another involving fraud and conversion.
She also represented debtors, creditors, and trustees in bankruptcy matters. Primarily, Ms. Poteet has experience representing individuals and businesses as debtors and creditors under Chapter 7, 11, and 13, ranging from routine bankruptcy filings to bankruptcy litigation. Specifically, she has litigated bankruptcy actions involving dischargeability of specific debts under11 U.S.C. § 523 and general dischargeability under 11 U.S.C. § 727.
Ms. Poteet graduated from San Diego State University with her Bachelor of Arts degree in Psychology. She earned her law degree from California Western School of Law where she served as the President of the Women's Law Caucus and President of the Native American Law Student Association.
Ms. Poteet is a member of the San Diego Bankruptcy Forum, the Native American Law Association, and the Lawyers Club of San Diego.
Ms. Poteet volunteers with the Credit Abuse Resistance Education program, where she teaches high school students about financial literacy.
