    Timothy Lindell is a partner in the firm’s insurance practice group.  Mr. Lindell’s practice focuses primarily on complex insurance coverage and bad faith litigation and advice, with an emphasis on continuous loss claims and/or those involving high exposure and multiple layers of coverage.  Mr. Lindell regularly handles cases in state and federal courts throughout California, from pre-litigation stages through appeal.
    With over 17 years of experience representing national insurers, Mr. Lindell has developed an expertise in commercial general liability, excess, WRAP, operator extra expense, D&O, E&O and EPL policies.  Mr. Lindell also routinely assists clients in drafting policy language and providing in-house training on claim handling, additional insured tenders and emerging legal issues confronting the insurance industry.
    Mr. Lindell also has an active trademark infringement practice where he represents corporate clients in the enforcement of their intellectual property rights.  He is also frequently called on to assist in the defense of employment related claims and litigation involving general contract and franchise disputes.
    Prior to joining Gordon & Rees, Mr. Lindell served as in-house counsel at a Fortune 100 company, managing litigation and providing contract, insurance, and risk transfer advice.  Having been responsible for the in-house management of litigation, Mr. Lindell has a personal understanding of the global impact legal issues can have on an enterprise and the business concerns that may come into play when a client seeks legal advice or is forced to prosecute or defend against a lawsuit. Mr. Lindell therefore strives to employ an aggressive but pragmatic approach toward litigation; focusing not only on preparing a matter for trial but positioning it for early resolution through dispositive motions and/or alternative dispute resolution.
    Examples of Mr. Lindell’s experience include:
    • Representing insurers in connection with coverage and “bad faith” litigation under primary, excess, and wrap policies arising out of complex construction defect, bodily injury, and intellectual property claims.
    • Representing insurers and third party administrators in relation to coverage and “bad faith” litigation involving errors and omission policies issued to real estate agents and brokers.
    • Prosecuting trademark infringement claims against former franchisees on behalf of a Fortune 500 company throughout the western half of the United States.
    • Providing coverage advice to insurers for property damage, pollution and bodily injury claims arising out of oil and natural gas exploration.
    • Providing coverage, claim handling, and risk transfer training to insurers and third party administrators.
