Prevailed on appeal before the Unites States Court of Appeals for the 4th Circuit in declaratory judgment action involving alleged “operations coverage” for toxic tort claims (March 2018)
Counsel for Chubb Group of Insurance Companies in a case argued in the U.S. Supreme Court entitled Travelers Indemnity v. Chubb Indemnity, 129 S.Ct. 2195 (2009). The case was remanded to the 2nd Circuit where Chubb prevailed on its due process/notice argument.
Bill leads a multidisciplinary team of attorneys which served as national coordinating counsel for a top property and casualty insurer in connection with numerous multibilliondollar asbestos bankruptcies and associated insurance coverage actions around the country.
Prevailed on appeal in Florida state court in a reformation claim involving GL policies issued to a medical device maker.
Summary judgment obtained for insurers in $20M advertising injury coverage claim in PA state court – upheld by PA Superior Court.
Bad Faith/Extra Contractual
Bill has served as national coordinating counsel for major property and casualty insurer. Claims included bad faith claim handling, spoliation, class action, excess verdict/time limit demand cases, including $55 million California burn case.
Represents several insurers in excess verdict and multimillion-dollar time limit demand cases.
Recently obtained dismissal of interference with contractual relations claim following successful rounds of motions to dismiss.
Uniform Commercial Code claims under Articles 2, 3, 4, 5 and 9.
Defense of lender liability claims involving commercial mortgage financing.
General contract litigation under UCC Article 2 and other non-UCC claims, including:
Contract action arising out of sale of defective wheels for portable MRI equipment.
Contract action arising from medical texts sales.
UCC S 2-315 fitness for particular purpose claim involving rock crushing equipment.
Successful pursuit of contractual indemnity claims in connection with property damage claims arising from environmental site.
Won 3rd Circuit affirmance of the summary dismissal of a class action by medical providers challenging an automobile insurer's use of computerized fee review software to adjust claims for medical reimbursement in St. Louis Park Chiropractic v. Federal Insurance Co., No. 08-3808, 2009 WL 2171221 (3d Cir. July 22, 2009).
Won dismissal of New York state court class action involving medical reimbursement.
Defense of franchisors and dealers in termination litigation under various states Franchise Practices Acts.
Toxic tort practice began in 1980 and spent the first nearly 10 years of career devoted to the national and regional counsel roles in the defense of mass products, toxic tort and asbestos cases. At one point, had over 200,000 cases under his command, 52 law firms, tens of millions of documents, all in the defense of one of the lead defendants in the asbestos litigation.
Overall, Bill’s toxic tort defense experience has continued for 30 years involving asbestos, benzene, cadmium, theatrical fog, hearing loss, etc. These assignments included acting as national counsel for Chubb Group in defending all of its insured computer manufacturers / keyboard suppliers sued in the repetitive stress injury litigation around the country.
Environmental defense claims involving single and multi-site CERCLA claims and under companion state statutes in NJ, PA and NY. Most recently, resolved a 5-year battle in the Northern District of Illinois involving leaking underground storage tanks at a trucking property shut down over 20 years before. Work on these cases has involved development of case strategy, motion practice and expert retention and development.
Defense of pollution liability coverage claims, including recent cadmium waste cases.
