New York Partner Claudia A. Costa Obtains Decisive Dismissal with Prejudice

In a New Jersey US District Court case, defending a Michigan Federal Judge, a prosecutor and an officer of the court, Gordon Rees Scully Mansukhani New York Partner Claudia A. Costa secured a decisive dismissal by the court.  This highly contested family dispute involved the conservatorship of the plaintiff’s wife, with alleged violations of the fourth, fifth, eighth, thirteenth and fourteenth amendments to the United States Constitution.

Costa successfully argued the dismissal of all claims for lack of personal jurisdiction and for failure to state a claim.  In its March 26, 2021 Order, the federal court agreed with Costa’s arguments and found there was “no conceivable basis” to amend the complaint to confer personal jurisdiction, and dismissed with prejudice.
