Denver Partner Andrew Lavin and Of Counsel Jack Mann obtained dismissal from the District Court, City and County of Denver, Colorado on behalf of their client.
The plaintiff alleged that the defendants, an interfaith alliance of various leaders of religious communities, engaged in defamation and outrageous conduct for submitting a letter of support for a mosque to law enforcement. The court agreed with the defense that the complaint failed to state a claim as the alleged communication was not actionable and/or the complaint established the truth of the matters asserted in the communication.
