State Hemp and CBD Laws and Regulations Contribute to Confusion:

On top of CBD’s complicated federal regulatory framework, businesses selling, distributing, or marketing CBD also need to confront a confusing patchwork of state and local laws affecting CBD.  Some states prohibit any CBD sales, while others permit CBD as a food and dietary supplement.

Currently, 46 states and the District of Columbia have legalized Farm Bill compliant CBD.  There are only four states where CBD remains illegal. In the 46 states that have legalized hemp based CBD, eighteen states prohibit its use in food or beverages, another 23 regulate its use, while five states have legalized CBD without regulating its use.
