Partner Allen Estes Discusses Project Claims and Delays at ABA Construction Forum

Gordon & Rees Seattle partner Allen W. Estes recently was a co-presenter at the American Bar Association Forum on the Construction Industry, held April 9-12 at the Roosevelt New Orleans.

At the April 10 presentation, titled “Counting the Chickens While They Hatch and the Double-Edged Sword of Tracking Project Claims and Delays,” Estes discussed the importance of having project procedures and mechanisms in place to effectively monitor and document the costs of change orders and claims to maximize the potential for appropriate recovery or successfully defend against unjustified claims. He also addressed the tactical use of project schedules to track delay impacts and events contemporaneously with continuing performance of work on a project.

The discussion was co-presented by Estes, John Livengood of Navigant, and Andrew Rhodes of The Rhodes Group, based on a paper they co-wrote.

Estes is a member of Gordon & Rees’s Construction, Commercial Litigation and Green Building Practice Groups, where he represents private owners, general contractors, subcontractors, and suppliers in all phases of project administration and delivery, including contract drafting/negotiation, project performance, project disputes, project closeout, and warranty issues. He advises clients on procurement issues, bid protests, and compliance for federal, state, and municipal contracts, and provides advice to owners, contractors and suppliers on transportation, infrastructure, marine, water/waste water, power and building projects.
