Gordon Rees Scully Mansukhani Partner Bo Thompson recently secured a complete defense result on behalf of three obstetrician clients who were alleged to have negligently treated a mother and baby during a labor and delivery that occurred in 2020.
GRSM obtained the testimony of medical experts in the fields of obstetrics, genetics, fetal and pediatric cardiology, pathology, and placental pathology. GRSM moved for summary judgment, and the judge agreed that all the claims against the three doctors, including claims for wrongful death of the minor child and emotional distress asserted by the parents, should be dismissed.
The judge’s order dismissed the claims with prejudice, and the co-defendant labor and delivery nurse, who was separately represented, was also exonerated from any alleged nursing wrongdoing in the same completely favorable ruling. While GRSM was prepared to defend the case through trial, a complete defense ruling ahead of trial saved weeks of preparation and trial for all involved.
