GRSM Secures Complete Dismissal in New York Housing Discrimination Lawsuit

Gordon Rees Scully Mansukhani Westchester Of Counsel Robert Fein obtained a complete dismissal in a housing discrimination lawsuit filed by a potential renter against a landlord and real estate agent in Kings County Civil Court.

The plaintiff alleged that they sustained damages for personal injuries, failure to provide proper services, breach of contract/warranty, loss of personal property, loss of time from work, rent gouging, scheme to defraud, discrimination, bait and switch, and violation of the Equal Credit Opportunity Act (ECOA).

Following a two-day bench trial, the judge found that there was insufficient evidence presented at trial to demonstrate a prima facie basis of entitlement to recover damages as to any of the causes of action that the plaintiff raised. Furthermore, the judge held that even if the plaintiff had made such a demonstration, the result would be the same, as the plaintiff also failed to establish or delineate the actual damages that he allegedly sustained. Accordingly, the action was dismissed in its entirety.
