GRSM Secures Dismissal on Behalf of National Insurance Broker and Owner in Mississippi Federal Court

GRSM Partner Hiawatha Northington II and Associate Sheridan Carr successfully secured a dismissal on behalf of the firm’s clients, a national insurance broker and its owner, in the United States District Court for the Northern District of Mississippi, Aberdeen Division.

The case arose from allegations by a contractor that one of his subcontractors negligently performed insulation services, leading to significant damage to property owned by one of the contractor’s clients and reputational damage to his contracting business. The contractor also claimed that GRSM’s client, an insurance broker for the subcontractor, misrepresented that the insurer would make a payment toward the repairs to the property. The plaintiff initially filed suit in Mississippi state court, asserting multiple causes of action against several defendants, including claims for negligence, breach of contract, fraud, breach of duty of good faith and fair dealing, infliction of emotional distress, and gross negligence.

After the matter was removed to federal court, GRSM aggressively defended its clients through written discovery and depositions, eventually pursuing a motion for summary judgment. In seeking dismissal of the claims, GRSM highlighted not only that the contractor maintained no contractual relationship with the broker which could give rise to a cause of action, but also that there was no evidence to support any of the contractor’s claims related to fraud or negligence. The federal court agreed, dismissing the entirety of the contractor’s complaint against GRSM’s clients with prejudice.

This ruling illustrates the importance of early comprehensive assessment of claims against defendants and targeted discovery to support eventual dispositive motions. GRSM’s efforts in this case yielded an exceptional result for its clients.
