GRSM Little Rock Team Secures Dismissal of Construction Negligence Claim on Behalf of Architecture Firm

Gordon Rees Scully Mansukhani Partner Haley M. Heath and Associate Mallory K. McElroy secured a victory in the Circuit Court of Benton County, Arkansas, on behalf of the firm’s client, an architecture firm, in a negligent construction lawsuit.

The plaintiff alleged that she sustained serious injuries when she fell from an outdoor exhibit designed by the architecture firm. The plaintiff alleged the architecture firm was negligent in designing, fabricating, and maintaining the exhibit in a reasonably safe condition by failing to include internal lighting and guardrails inside the exhibit.

GRSM’s team filed a motion for summary judgment based on the argument that the suit was time-barred because the plaintiff failed to bring suit against the architecture firm within three years of the last date of construction. The plaintiff argued the firm had an ongoing duty to maintain the exhibit and that the statute of limitations began to run from the date of injury. Granting GRSM’s motion, the circuit court found there was no ongoing maintenance duty and granted summary judgment.
