A Gordon Rees Scully Mansukhani trial team, led by Partner Brian Ledger and Associate Chassen Palmer, with support from Senior Counsel Chris Johnson and Partner Matt Nugent, as well as Paralegal Sunita Comer and Legal Secretary Denise Doonkeen, achieved an outstanding outcome for the firm’s client, a pool maintenance company, in a recent jury trial involving a subrogation claim.
The underlying case involved a settlement paid by a property management company after two plaintiffs were exposed to carbon monoxide from a malfunctioning spa heater at an apartment complex. In the subrogation claim, the property management company sought to recover seven figures paid from the underlying action. Going into the trial, the subrogation plaintiff’s demand was $800,000.
After several days of trial and effective cross-examinations of the plaintiff’s witnesses, the jury’s non-verbal reactions reflected strong leanings in favor of GRSM’s client. Given the potential for an attorney’s fees award for GRSM’s client, the GRSM team was able to negotiate a walk-away settlement, with the plaintiff agreeing to a dismissal in exchange for nothing more than a waiver of costs and attorney’s fees.
