Gordon Rees Scully Mansukhani Denver Partner Hannah Brown Goehring and Los Angeles Partner Reid Dammann recently secured a significant victory for a client in a California invasion of privacy claim under California Penal Code Section 631 (CIPA).
The case involved allegations that the client’s website violated CIPA by intercepting, recording, and sharing the plaintiff’s electronic communications with the website and allegedly conspiring with Meta to do the same. With substantial experience handling similar claims, the GRSM team was able to demonstrate that the plaintiff’s claim was barred under the statute of limitations, ultimately convincing the plaintiff’s counsel to dismiss the claim before arbitration began.
This outcome underscores the importance of having a clear and binding terms of use and consent policy on a client’s website to safeguard against potential claims. The firm’s Cyber, Privacy & Data Security practice continues to protect clients in the ever-evolving landscape of privacy and data security, using strategic litigation approaches to resolve complex issues and effectively address claims.
